Commerce Insurance Claims and Settlements: A Car Accident Attorney’s Perspective
COMMERCE Insurance was founded in 1972 in the south-central Massachusetts town of Webster where the company is still located and headquartered.
In June 2008, The Commerce Group, Inc. was acquired by MAPFRE who is Headquartered in Madrid, Spain and is the largest insurance group in Latin America and has a presence in 43 countries, with about 51,000 agents worldwide.
At the time of this acquisition, COMMERCE had 31% market share in 2008, which was the same year Massachusetts made reforms and deregulated the car insurance industry to entice other companies to underwrite in the Commonwealth, which has caused Commerce’s market share to dip 3.7 percentage points as of 2011 but the company is still the largest writer by far in the Commonwealth.
Based on our experience, our lawyers seem to think that COMMERCE claims adjusters are very amicable and desire to resolve cases when it is within their authority to do so but often that authority is very limited. Also, the ability to reach COMMERCE claims on the phone is by far one of the companies best attributes as you may choose to wait on hold until the adjuster is able to finish her previous phone call, which makes contacting them very easy. But even though amicable and easy to contact, many of the COMMERCE claims adjusters authority in settling cases is at a very low range without filing suit. Therefore, many of our clients who have claims against COMMERCE chose to file a lawsuit, as opposed to settling their accident claim with COMMERCE. Most of their cases are defended by the law offices of Fuller, Rosenberg, Palmer & Beliveau out of Worcester, Massachusetts.
