Alimony aka Spousal Support
Even though there are certain caps concerning alimony in Massachusetts with the passage of the alimony reform law, it still stands true that just as a short-term marriage does not prevent an award of alimony, a long-term marriage does not guarantee alimony. But Massachusetts law requires only that alimony may be awarded in cases where it is “just and equitable.”
The most straight forward limits in the new alimony law include:
- In marriages lasting five years or less, divorce alimony is to continue no longer than half the length of the marriage.
- In marriages six to 10 years long, alimony is capped at 60 percent of the length of the marriage.
- A schedule will be established by which parties to the alimony agreement may appeal for adjustment.
Nevertheless the “just and equitable” standard gives the judge wide discretion when he or she is considering whether to award alimony. That is why it is important to have an experienced alimony attorney on your side. At Brabant & Huynh we have years of experience successfully fighting for and against alimony.
